1. OBJECT OF THE ONLINE CONTRACT
The "on-line" contract, accepted on the "www.bebabbigliamentomoto.com" website, is intended to be stipulated between B&B ABBIGLIAMENTO MOTO, with registered office in Parma (PR), Via O. Lizzadri N. 5/b, and a Customer, through an electronic sales system called e-commerce. Customer means, in relation to contracts for the supply of goods or the provision of services, the Subject who formalizes a purchase on the site "www.bebabbigliamentomoto.it". The term e-commerce refers to transactions of a commercial nature (purchase of products, economic transactions, exchange of commercial information, etc.), carried out electronically via the internet on the "www.bebabbigliamentomoto.it" domain.
2. SALES PRICES, PURCHASE AND PAYMENT METHODS, INVOICING
2.1 The sales prices displayed on the "www.bebabbigliamentomoto.com" website are intended as an offer to the public by B&B ABBIGLIAMENTO MOTO, including VAT and any other tax. The prices shown do NOT include shipping costs. The Customer will take care to view the amount of transport costs, before proceeding with the purchase. The purchase contract is finalized only by correctly filling in the order form published on the site and by consent to the purchase, expressed through online membership. The customer can choose the payment method before confirming the order, using one of the permitted methods.
2.2 Any sales invoice must necessarily be requested at the time of insertion of the purchase order. It will not be possible to issue an invoice after the order has been processed, or after the delivery of the goods to the shipper in charge of transport.
3. COSTS AND METHODS OF TRANSPORT AND DELIVERY
3.1 The shipment of the purchased goods is entrusted to transport companies that carry out national express courier service. NO RESPONSIBILITY CAN BE ATTRIBUTED TO B&B ABBIGLIAMENTO MOTO IN CASE OF LOSS, DAMAGE OR DELAY IN DELIVERY OF THE GOODS SHIPPED.
3.2 The electronic shopping cart system automatically calculates and adds to the order the costs related to shipping costs. Shipping costs and any supplements are set out in detail in the"Shipping costs"section.
3.3 The supply of tangible goods via the Internet, being assimilated to mail order sales, is exempt from the obligation of tax certification (receipt and receipt), as well as the issuance of the invoice, unless explicitly requested by the Customer. In this B&B ABBIGLIAMENTO MOTO will issue a regular invoice for the products purchased, inserting the document inside the packages shipped, or sending the document by e-mail to the order holder. For the issuance of the invoice, the information provided by the Customer at the time of the order shall prevail. No change in the invoice will be possible after the issuance of the same.
3.4 Unless explicitly indicated by our Customer Service, delivery is intended at street level. Upon delivery of the goods by the courier, the Customer is required to check:
- that the number of packages delivered corresponds to what is indicated in the shipping slip delivered by the courier;
- that the packaging is intact, not damaged, nor wet or otherwise altered, even in the closing materials (adhesive tape, holds).
- Notes supplementary to delivery: if the package delivered is damaged or altered (e.g. with adhesive tape cut and / or replaced) we invite the Customer to accept the package by applying the note "Acceptance with Reserve" on the courier's document. In the event that the courier's delivery document shows "Accepted without reservation of control", it will not be possible in any way to obtain the reimbursement provided by the insurance. We inform customers that the insured shipment provides, in the manner and terms defined by the contracts with the shipper, the reimbursement of Euro 6.20 for each kilogram of goods weight.
3.5 Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, in the manner provided for in this document.
3.6 In case of non-collection within 5 working days of the material in storage at the courier's warehouses due to repeated impossibility of delivery to the address indicated by the Customer at the time of the order, the order will be automatically canceled.
4. RESPONSIBILITY FOR TRANSACTIONS AND SHIPMENTS
B&B ABBIGLIAMENTO MOTO declines all responsibility in case of disservices attributable to force majeure, events that prevent the regular success of the contract, and is not responsible for loss of goods or damage suffered during transport.
B&B ABBIGLIAMENTO MOTO is also not responsible for any illicit and fraudulent use of credit cards, checks and other means of payment, since at no time during the purchase procedure it is able to recognize the credit card number of the buyer, who, operating on a protected connection, sends the data directly to the Bank that manages the service. In the same way it is not able to check the correct and lawful origin of the credit title that is delivered by the customer at the collection of the goods.
5. WARRANTY
5.1 All products sold by B&B ABBIGLIAMENTO MOTO are covered by a conventional warranty of 24 months from the date of purchase (unless otherwise indicated on the product page) for defects of conformity, pursuant to Legislative Decree 24/02.
5.2 The ESSENTIAL conditions to benefit from warranty service are as follows:
- the Customer must send a communication to the address info@bebabbigliamentomoto.com,describing, with appropriate clarity and abundance of details, the alleged defects found. In support of this communication it will be NECESSARY to attach images, of adequate quality, to support the complaint exposed.
- the Customer must return the product to our. headquarters (B&B ABBIGLIAMENTO MOTO. - Via O. Lizzadri N. 5/B - 43126 San Pancrazio - PR) with shipping free of charge (transport costs borne by the Sender). Any shipments in port assigned, or with transport costs borne by the Recipient, will be refused and rejected to the sender.
It should be noted that in the absence of the required documentation (e-mail communication and photographic documentation) and / or failure to receive the goods considered defective, it will not be possible to activate the verification procedure of the warranty terms.
5.3 The Manufacturer's conventional warranty is provided in the manner described in the documentation inside the product packaging. B&B ABBIGLIAMENTO MOTO, following receipt of the report by the Customer (according to the rules set out in point 5.2), will report to the Supplier / Manufacturer the anomaly found and, if requested, will send the goods for the necessary checks.
5.4 The warranty applies to the product that has a lack of conformity, provided that the product itself has been used correctly, in compliance with its intended use and as provided in any attached technical documentation. This guarantee is reserved for the private consumer (a natural person who purchases the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number reference in the order form). In case of lack of conformity, B&B ABBIGLIAMENTO MOTO provides, at no cost to the Customer, to restore the conformity of the product by repair, or replacement, until the termination of the contract. If the right to replace the product under warranty is not recognized, B&B ABBIGLIAMENTO MOTO will report the reasons to the Customer, who will be charged for any costs of verification, and / or control, and / or restoration requested by the Supplier / Manufacturer, as well as the related shipping costs.
5.5 In the event that, for any reason, it is not possible to return to its Customer a product under warranty (restored or replaced), B&B ABBIGLIAMENTO MOTO may proceed at its discretion to return the amount paid, or to replace it with a product of equal or superior characteristics.
5.6 No damage can be requested to B&B ABBIGLIAMENTO MOTO for any delays in carrying out repairs, replacements, or checks on the product.
5.7 In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging, any documentation and accessory equipment, such as manuals, cables, etc ...).
We recommend particular attention to the packaging, in order to avoid damage to the product and the packaging during transport.
6. RIGHT OF WITHDRAWAL
In accordance with the provisions of Legislative Decree 6 September 2005 n. 206 (and subsequent amendments and additions), the Consumer Customer, if not satisfied with the products or the content of the services purchased from the Seller, may return the products themselves or renounce the right to provide services and obtain a refund of the price already paid at the time of advance payment.
How to operate: To this end, the Customer must contact the Seller within 14 days following the delivery of the products or within 14 days following the purchase of the services, sending a communication by registered letter with return receipt BeB Abbigliamento Moto Via O. Lizzadri N. 5/b cap 43126 Fraz. San Pancrazio (pr), containing all the information necessary and useful for a correct processing of the return and refund practice. This communication must necessarily contain all of the following: a. the express will of the Customer to withdraw in whole or in part from the purchase contract; b. the number and copy of the document (invoice – transport document) proving the purchase of the order with respect to which you intend to exercise the right of withdrawal; c. the description and codes of the Products with respect to which the right of withdrawal is exercised. The re-crediting, including shipping costs, will be made by the Seller within 14 days of receipt of the communication by registered letter with return receipt mentioned above.
Please note that the returned product must be intact and with the relative tag attached as per the factory.

The shipping costs related to the return of the products, in case of application of the Right of Withdrawal, are charged to the Customer, as well as any costs for packaging, and / or any ancillary services.
The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the Customer.
B&B ABBIGLIAMENTO MOTO is in no way responsible for damage or theft / loss of goods returned by unsured shipments.
Upon delivery of the returned product, all checks on the status of the product will be carried out.
6.4 The right of withdrawal is totally lost, for lack of the essential condition of integrity of the goods (packaging and / or its contents), in cases where B&B ABBIGLIAMENTO MOTO ascertains:
- damage to the product, and / or evidence of use, tampering, or assembly, of the product
- damage, or lack of product packaging, and / or packaging integrating the packaging
- the absence of integral elements of the product (accessories, cables, manuals, etc.);
In these cases the right of withdrawal will NOT be applicable and, consequently, no refund will have followed.
The product will remain available to the Customer who can collect it at his own expense.
6.5 B&B ABBIGLIAMENTO MOTO will refund the Customer the amount relating to the returned goods (therefore excluding the transport costs originally incurred for sending the goods) within 15 days of receipt of the returned goods, through the transfer procedure of the amount charged to the Credit Card or by Bank Transfer. In the latter case, it will be the Customer's authority to promptly communicate the data relating to the current account (name of the account holder and IBAN coordinates) on which to credit the refund.
Shipping costs will NOT be refunded. In the event that the Customer has benefited from free shipping, the amount relating to shipping costs (€ 13.00, depending on the payment forma chosen) will be deducted from the refund amount.
6.6 Some products on sale report in the information sheet the note "Right of Withdrawal: NOT APPLICABLE". These are products supplied following a specific request of the Customer. ON THESE PRODUCTS IN NO CASE AND FOR NO REASON WILL THE RIGHT OF WITHDRAWAL BE APPLICABLE.
To avoid damage to the product and the original packaging, we recommend that you provide adequate packaging.
7. BUYER'S OBLIGATIONS
The consumer undertakes and obliges, once the "on-line" purchase procedure has been completed, to provide for the printing and storage of these general conditions, which, moreover, he will have already viewed and accepted, as a mandatory step in the purchase, as well as the specifications of the product being purchased. It is strictly forbidden for the buyer to enter false data, and / or invented, and / or fantasy, in the registration procedure necessary to activate the process for the execution of this contract and the related further communications; the personal data and the e-mail must be exclusively their real personal data and not of third parties and / or fantasy. It is expressly forbidden to make double registrations corresponding to a single person or to enter data of third parties. B&B ABBIGLIAMENTO MOTO reserves the right to prosecute any violation and abuse, in the interest and for the protection of consumers.
8. AUTHORIZATIONS
By filling in the appropriate space on the website, the Customer authorizes B&B ABBIGLIAMENTO MOTO to use his credit card, or other card issued to replace it, and to debit his current account in favor of B&B ABBIGLIAMENTO MOTO the total amount shown as the cost of the purchase made "on-line". The procedure takes place through a secure connection directly connected to the Bank, owner and manager of the "on-line" payment service, to which B&B ABBIGLIAMENTO MOTO cannot access. If the consumer should exercise the right of withdrawal (see point 8 of these general conditions) the amount to be refunded will be credited to the same credit card or in the way chosen by the customer.
9. CONTRACTUAL TERMINATION AND EXPRESS TERMINATION CLAUSE
B&B ABBIGLIAMENTO MOTO has the right to terminate the contract by giving simple notice to the Customer. In this case, the Customer will only be entitled to a refund of any sum already paid. The obligations assumed by the Customer pursuant to art. 7 (Obligations of the buyer), as well as the guarantee of the successful completion of the payment that the customer makes by the means referred to in art. 2 (sales prices and purchase methods), are essential, so that by express agreement, the non-fulfillment, by the Customer, of only one of these obligations will determine the termination of the contract by law, without the need for judicial decision, without prejudice to the right for B&B ABBIGLIAMENTO MOTO to take legal action for compensation for further damage.
10. PROCESSING OF PERSONAL DATA
The Customer, by accepting these conditions of sale, declares to have read, understood and accepted in full, and without any reservation, the rules governing the processing of personal data, set out in the specific section on the website ("Privacy").
11. APPLICABLE LAW
The sales contract between the Customer and B&B ABBIGLIAMENTO MOTO is concluded in Italy and governed by Italian law. For the resolution of any civil and criminal disputes arising from the conclusion of this sales contract, the jurisdiction is exclusively that of the Court of Parma.
